Chairman of the State Commission for Protection of Economic Competition Artak Shaboyan had two-day official visit to the Portuguese Republic to participates in the annual conference of the International Competition Network.
Commission's press service reported to Finagent.am that A. Shaboyan made a speech at the conference, presenting the work done and the most significant achievements of the Competition Authority. Commission President's speech dealt with the theme of market access barriers, ecpesially the use of simulation trademark.
As an example, A. Shaboyan represent to partners several cases. He spoke about a recently completed investigation: "Anelik Bank" against "NOY-FIRM" cooperative. The problem is that Anelik Bank registered the same name in Intellectual property agency and is a trademark of its proprietor, and in 1999 registered the domain www.anelik.am, which is the website of the bank. However, later it was discovered that another company, "Noy-firm" AK has registered the domain named www.anelikbank.am.
Examining the circumstances of the case, the State Commission for Protection of Economic Competition stated that «www.anelikbank.am» domain name is confusingly similar to the trademark use of the same bank. According to the Commission's statement, "NOY-FIRM" cooperative’s behavior can confuse consumers because they may think that the domain name "www.anelikbank.am" is web-page of the same bank. In this case, Noy-firm "CC has proved to be unfair competitor using a registered trademark belonging to someone else. The company applied the sanction and ordered to stop the activity.
